Grounds for a personal injury lawsuit

In Louisiana, proving fault involves demonstrating that someone was negligent.  That person must have owed a duty to the injured person and failed to carry out that duty.  Once negligence has been established, it is necessary to prove that injuries resulted from the negligence, and that the injuries resulted in financial loss.

What you need to bring to the first attorney visit

Each accident is different, and it is not always possible to immediately obtain some evidence for lawsuits.  For example, if injury sends anyone to the hospital, picture-taking at the accident site will not be possible.  But, try to bring as much evidence showing the cause of the accident and injuries sustained.  The following are some suggestions:

  • Detailed notes on what happened before, during, and after the accident, including your best recollection of anything that was said, and contact information for everyone involved, including witnesses
  • Photos of anything pertaining to the accident, including damage to vehicles and the accident site in a car accident, and injuries sustained
  • Physical evidence, such as items damaged, clothing worn and damaged from the accident, and, when a product caused injury, the instructions, packaging, and the product and parts
  • Copies of police reports
  • Complete medical records documenting all medical or psychological treatment, prognoses, and expense receipts until all treatment is complete
  • Receipts for any related medical devices and medication, including over-the-counter medications for pain and bandages
  • Records for lost wages
  • Receipts for home care for you or family members if you were unable to care for them
